국내에 거주하는 외국인 수가 증가함에 따라, 자연스레 외국인 범죄 역시 증가하고 있습니다.

 

경찰청에 따르면 작년 한 해 동안 국내에서 발생한 외국인 형사 범죄가 3만 건이 넘는 것으로 집계되었습니다.

 

법무부와 경찰청 통계에 따르면 지난해 국내 체류 외국인은 25만7584명으로 이 중 불법체류자는 42만3675명, 외국인 피의자는 3만2744명으로 파악되었습니다.

 

통상 외국인 범죄라 하면, 살인·강도·절도·폭력을 4대 범죄를 꼽는데, 주목할 점은 최근 몇 년 사이에 음주운전, 마약, 도박 범죄가 2배 가까이 급격히 증가한 것으로 나타났습니다.

 

이에, 경찰청은 올해 3월 외국인 범죄 감소를 위해 올해 △ 사기․도박 범죄 △ 마약류 범죄 △ 건설 현장 외국인 노동자 관련 범죄 등 세 유형을 중점 단속할 것임을 밝혔습니다.

 

경찰의 집중 수사가 이루어지는 만큼, 향후 단기적으로 외국인 범죄가 급증할 것으로 예견되는데요.

 

그런데 외국인 피의자는 형사 범죄를 저지른 경우 그에 따른 형사처벌을 받게 되지만 별개로 일정 형 이상을 받게 되면 출입국관리법에 따라 출국조치의 대상이 될 수 있습니다.

 

따라서, 근로 또는 학업 목적으로 한국에 거주하는 외국인이 음주운전, 마약, 도박 등의 형사범죄에 연루된 경우라면, 형사사건에 대한 변호 뿐만 아니라 출국조치 관련 행정 불복절차 역시 가능한 변호사의 조력을 받을 필요가 있겠습니다.

With the increasing number of foreigners residing in Korea, foreign crime is also naturally on the rise.

According to the National Police Agency, the number of foreign criminal offenses in Korea exceeded 30,000 last year.

According to statistics from the Ministry of Justice and the National Police Agency, there were 257,584 foreigners staying in Korea last year, of which 423,675 were illegal immigrants and 32,744 were foreign suspects.

Typically, four major crimes are considered foreign crimes: murder, robbery, theft, and violence. Notably, in recent years, crimes such as drunk driving, drugs, and gambling have increased rapidly by nearly twofold.

In response, the National Police Agency announced in March of this year that it would focus on cracking down on three types of crimes to reduce foreign crime: 1) fraud and gambling crimes, 2) drug crimes, 3) crimes related to foreign construction workers.

As the police are intensively investigating these crimes, it is expected that foreign crime will surge in the short term.

However, foreign suspects are subject to criminal penalties for criminal offenses, but they may also be subject to deportation under the Immigration Control Act if they receive a certain sentence or more.

Therefore, foreigners residing in Korea for work or study who are involved in criminal offenses such as drunk driving, drugs, or gambling may need to seek legal assistance from an attorney who can handle both criminal defense and administrative appeals related to deportation.
